Terms of Service

1. Acceptance of Terms

By accessing or using Modern Vibe Coding (“the Platform”), you agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated by reference. If you do not agree to these terms, you may not use the Platform.

2. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 16 years old to create an account (or the minimum age required by your jurisdiction). If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Subscriptions & Payments

Membership subscriptions are billed monthly or annually through our payment processor, Polar. Prices are listed in US dollars and are subject to change with 30 days' prior notice. You may cancel at any time from your Billing page; access continues until the end of your current billing period. New subscribers receive a 7-day free trial. Cancellation and returns are governed by our Return Policy.

4. Content & Intellectual Property

All course content, code examples, illustrations, and materials are the property of Modern Vibe Coding or its licensors and are protected by copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access the content for personal, non-commercial learning purposes. You may not redistribute, resell, publicly share, scrape, or create derivative works from course content without prior written permission.

5. Acceptable Use

You agree not to:

• Share your account credentials with others or allow multiple people to use a single account.
• Use automated tools (bots, scrapers) to access or download course content.
• Attempt to circumvent access controls, paywalls, or rate limits.
• Upload malicious content or interfere with the Platform's operation.
• Use the Platform for any unlawful purpose.

6. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS. COURSE CONTENT IS PROVIDED FOR EDUCATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE PROFESSIONAL ADVICE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MODERN VIBE CODING AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

8. Indemnification

You agree to indemnify, defend, and hold harmless Modern Vibe Coding and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to access the Platform ceases immediately. Provisions that by their nature should survive termination (including Sections 4, 6, 7, 8, 10, and 11) shall survive.

10. Modifications to Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where practicable, notify you by email or in-app notice at least 14 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.

11. Governing Law & Disputes

These Terms are governed by the laws of the jurisdiction in which Modern Vibe Coding is established, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Platform shall first be addressed through good-faith negotiation. If the dispute is not resolved within 30 days, either party may pursue resolution through the competent courts of that jurisdiction. Nothing in this section limits your rights under mandatory consumer protection laws of your country of residence.

12. Force Majeure

We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, internet or power outages, government actions, or failures of third-party service providers.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
